General conditions
You donate to the Receiving Party below:
Stichting Wees een Kind, having its registered office in Zoetermeer, registered in the trade register of the Chamber of Commerce under number 30281471, hereinafter to be referred to as: Orphan a Child Foundation.
Article 1. Definitions
Donation form: means of making a donation online to Orphan a Child Foundation.
Giving party: the natural - or legal person who makes a donation to Stichting Wees een Kind by means of an electronic transfer, via the website of Stichting Wees een Kind.
Online donation: giving money by electronic transfer through the Orphan a Child Foundation website to Orphan a Child Foundation.
Article 2. Applicability
These Terms and Conditions apply to any online donation to Orphan a Child Foundation. The giving party, by donating online, agrees to these Terms and Conditions.
Stichting Wees een Kind reserves the right to make interim changes to the terms and conditions.
Article 3. Rights Orphan a Child Foundation
Online donations fully benefit the Orphan a Child Foundation.
Stichting Wees een Kind is completely free to allocate these online donations, provided they are in accordance with its statutory objectives. Ownership of the donated amount passes to Stichting Wees een Kind after the donated amount has been credited to Stichting Wees een Kind's bank account. Liability: Stichting Wees een Kind accepts no liability for damages on the part of the giving party as a result of the donation made by the giving party. The giving party indemnifies Stichting Wees een Kind for all claims by third parties for damages suffered by those third parties as a result of the giving party's donation to Stichting Wees een Kind.
Article 4. Rights giving party
The giving party has a cooling off period for online donations via a donation form of eight (8) business days. During this period, the agreement may be terminated in writing by the giving party by sending an email to info@weeseenkind.nl.
Article 5. Duties Orphan a Child Foundation
Stichting Wees een Kind undertakes to spend the amounts received in accordance with its statutory objectives. Stichting Wees een Kind takes appropriate technical and organizational measures to secure communication, personal data, electronic transfer of data and online donations and ensures a secure web environment. All persons who, on behalf of Stichting Wees een Kind, are authorized to take cognizance of the personal data are bound to secrecy.
Article 6. Giving party obligations
To make a donation online, the giving party must be at least 18 years of age. If a giving party has not reached the age of 18, an online donation must be made through one of the parents or guardians. The giving party provides the correct name and identity. The giving party shall make donations only with funds over which he/she is entitled to dispose and control. Stichting Wees een Kind will report to the police if the giving party makes donations under a false name or identity or with funds that are not at his/her disposal and under his/her control. The giving party shall ensure that any partner, within the meaning of Article 88 Book 1 of the Civil Code, has given his/her prior consent to the donation, if it can be considered unusual and/or excessive.
Article 7. Personal Data Protection Act
Stichting Wees een Kind processes the personal data provided by the donating party to Stichting Wees een Kind in accordance with all (legal) regulations regarding the data to be processed, including in particular the regulations under or pursuant to the Wet bescherming persoonsgegevens (Personal Data Protection Act). These personal data will be processed by Stichting Wees een Kind for the purpose of establishing donations, for the acceptance and settlement of other benefactions, for carrying out marketing activities, as well as to comply with legal obligations. The giving party has the right to oppose the processing of this data for marketing activities. The giving party has the right to check whether the data registered by Stichting Wees een Kind are correct and the right to have them corrected, if the data prove to be incorrect. Stichting Wees een Kind is entitled to request identification of the giving party in this context.
Article 8. Final provisions
The disclaimer and privacy statement of Stichting Wees een Kind apply in full. If parties, in the event of a dispute, do not succeed in reaching mutual agreement, they hereby declare that the court in Rotterdam is competent to take cognizance of the dispute.Parties also declare that Dutch law applies.
